This website is operated by Playmantis PTY LTD (“we”, “us”, “our”). By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including policies referenced here or available by hyperlink (such as our Privacy Policy, Payment Policy, Shipping Policy, and Return and Refund Policy). These Terms apply to all users of the site.

Please read these Terms carefully before using the site. If you do not agree to the Terms, you may not access the site or use the Service. Any new features or tools added to the current store are also subject to these Terms. We may update these Terms by posting changes on this page. Your continued use of the site constitutes acceptance of the changes.

Our store is hosted on Shopify Inc., which provides the e‑commerce platform enabling us to sell products and services to you.

1. Online store terms

By agreeing to these Terms, you represent that you are at least the age of majority in your state or territory of residence, or you are the age of majority and have given consent for any minor dependants to use this site. You must not use the Service for any unlawful or unauthorised purpose, transmit malicious code, or violate any laws in your jurisdiction while using the Service. A breach of these Terms may result in immediate termination of your access.

We may refuse service to anyone at any time. Content you submit (excluding payment card information) may be transferred unencrypted over various networks and adapted to technical requirements. Payment card data is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission. Headings are for convenience only and do not limit these Terms.

3. Information accuracy and availability

We aim for accuracy but do not warrant that information on the site is accurate, complete, or current. Material is provided for general information only. Historical information is not current and is for reference. We may modify content at any time without obligation to update. Your reliance on site material is at your own risk.

4. Modifications to the Service and prices

Prices and product availability are subject to change without notice. We may modify or discontinue the Service (or any part of it) at any time. We are not liable to you or any third party for modifications, price changes, or discontinuance.

5. Products and descriptions

Some products may be available exclusively online and may have limited quantities. Sales and returns are governed by our Return and Refund Policy. We make every effort to display colours and images accurately but cannot guarantee your device’s display. We may limit sales to any person, household, region, or jurisdiction and limit quantities per order. All product descriptions and pricing are subject to change at any time at our sole discretion. We may discontinue any product at any time. We do not warrant that products or the Service will meet your expectations or that errors will be corrected.

Note for trading card singles: all singles are Near Mint (NM) unless otherwise stated on the product page. See our Return and Refund Policy for condition definitions and remedies under the ACL.

6. Orders, billing, and account information

We may refuse any order and may limit or cancel quantities per person, household, or order, including orders placed under the same account, card, or address. If we change or cancel an order, we may attempt to notify you via the contact details provided at checkout. We may limit or prohibit orders that, in our judgment, appear to be placed by dealers, resellers, or distributors.

7. Optional tools and integrations

We may provide access to third‑party tools or integrations (for example, Shopify features, payment gateways, marketing tools) which we do not monitor or control. You acknowledge that such tools are provided “as is” and “as available” without warranties or endorsement. Your use of optional tools is at your own risk and you should ensure you agree to the relevant third party’s terms.

Third‑party links on the site may direct you to websites not affiliated with us. We are not responsible for examining or evaluating their content or accuracy and we are not liable for any third‑party materials, websites, products, or services. Review third‑party policies before engaging in any transaction with them.

If you send us submissions (e.g., reviews, ideas, suggestions, images) whether requested by us or not, you grant us a non‑exclusive, worldwide, royalty‑free, sublicensable licence to use, reproduce, publish, translate, distribute, and display such content in any media, subject to our Privacy Policy. We may monitor, edit, or remove content we consider unlawful, offensive, or otherwise objectionable or that violates any party’s rights or these Terms. You are responsible for your submissions and warrant they do not infringe third‑party rights or contain malware or unlawful content.

Occasionally there may be information on the site or Service that contains typographical errors, inaccuracies, or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times, availability). We reserve the right to correct, change, or update information or cancel orders if any information is inaccurate at any time without prior notice, including after an order is submitted, as permitted by law.

In addition to other prohibitions in these Terms, you must not use the site or its content for unlawful purposes; to solicit unlawful acts; to violate any laws; to infringe intellectual property rights; to harass, abuse, defame, intimidate, or discriminate; to submit false or misleading information; to upload malware; to collect personal information of others; to spam or scrape; for obscene or immoral purposes; or to circumvent security features. We may terminate your use of the Service for prohibited conduct.

13. Australian Consumer Law, warranties, and liability

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law (ACL) or other applicable laws that cannot be excluded. If the ACL applies, our liability for failure to comply with a consumer guarantee is limited, to the extent permitted by law, to one or more of the following at our option: replacement of goods or supply of equivalent goods; repair of goods; payment of the cost of replacing or acquiring equivalent goods; or payment of the cost of having the goods repaired.

You agree to indemnify, defend, and hold harmless Playmantis PTY LTD and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or third‑party rights.

If any provision of these Terms is unlawful, void, or unenforceable, that provision is deemed severed and does not affect the validity and enforceability of remaining provisions.

These Terms are effective unless terminated by you or us. You may terminate by ceasing to use the site. If, in our judgment, you fail to comply with any term, we may terminate access at any time without notice and you remain liable for amounts due up to and including the date of termination.

17. Entire agreement

These Terms and any policies or operating rules posted by us on this site constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements or communications. Any ambiguities in these Terms are not to be construed against the drafting party.

18. Governing law and jurisdiction

These Terms and any separate agreements whereby we provide you Services are governed by the laws of Queensland, Australia. You submit to the non‑exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
